1.Agreement to Terms
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Climatical Safaris Adventure (“we,” “us,” or “our”), concerning your access to and use of the Climatical Safaris Adventure website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms and Conditions. If you do not agree with all of these Terms and Conditions, then you are expressly prohibited from using the Site and you must discontinue use immediately.
2.Intellectual Property Rights
Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws. The Content and the Marks are provided on the Site “AS IS” for your information and personal use only. 3.Booking and Payments
- Reservations: All safari bookings and tour reservations made through the Site are subject to availability and acceptance by us. We reserve the right to refuse or cancel any booking for any reason.
- Pricing: Prices for our safaris and services are subject to change without notice. We reserve the right at any time to modify or discontinue a service without notice.
- Payment Terms: A deposit is typically required to secure your booking, with the balance due a specified number of days prior to departure. Specific payment terms, including accepted payment methods, will be outlined during the booking process.
4.Cancellations and Refunds
Our cancellation and refund policies apply to all booked tours and safaris.
- Cancellations made by you must be submitted in writing.
- Refund eligibility is determined by the timeline of your cancellation prior to the departure date. Detailed cancellation penalty brackets (e.g., 60 days, 30 days, 15 days prior) will be provided at the time of booking.
- We reserve the right to cancel any tour due to unforeseen circumstances, including but not limited to extreme weather, political instability, or insufficient participant numbers. In such events, a full refund or alternative travel dates will be offered.
5.Travel Requirements and Responsibilities
- Travel Documents: You are responsible for obtaining and maintaining valid passports, visas, permits, and vaccination certificates required for your itinerary.
- Health and Fitness: Safaris can be physically demanding. By booking, you confirm that you are physically fit to participate in the activities outlined in your itinerary and have disclosed any medical conditions or dietary requirements to us.
- Insurance: We strongly recommend that you obtain comprehensive travel insurance, including coverage for medical emergencies, trip cancellation, and baggage loss.
6.Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. As a user of the Site, you agree not to:
- Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
- Circumvent, disable, or otherwise interfere with security-related features of the Site.
- Engage in unauthorized framing of or linking to the Site.
- Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
7.Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site.
8.Governing Law
These Terms shall be governed by and defined following the laws of Tanzania. Climatical Safaris Adventure and yourself irrevocably consent that the courts of Tanzania shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
9.Limitations of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site or our safari services, even if we have been advised of the possibility of such damages.
